£90,0000 compensation recovered following sensitisation to platinum salts

Jonathan Herbert, specialist personal injury lawyer acting for the claimant, successfully obtained a settlement of £90,000 to compensate him for his injury and past and future financial losses.

Mr C became sensitised to chlorinated (halogenated) complex platinum salts as a result of exposure to various chemicals during employment with Johnson Matthey plc at its Enfield premises. He could no longer continue working for Johnson Matthey and therefore lost income, membership of a share incentive plan and company pension contributions. He also incurred relocation expenses. He reported subsequent respiratory and dermatological injury.

We were instructed to bring a claim for compensation and acted on a ‘no win, no fee’ basis.

The defendant admitted breach of duty but failed to engage in alternative dispute resolution. We were therefore obliged to issue Court proceedings seeking damages. The defendant then alleged contributory negligence on the part of the claimant by reason of him smoking during his period employment which he denied. The case was prepared for trial with associated statement preparation and expert instruction. At a settlement meeting with the defendant shortly before trial, a settlement of £90,000 was agreed.
