Our Will, Trust & Estate Disputes team were instructed by the executors of an estate who were faced with beneficiaries challenging aspects of the estate administration. Our clients came to us wanting to understand their position in circumstances where they were being accused of breach of fiduciary duty, breach of trust and other related matters.
We advised our clients on their exposure to the claims, with reference to the manner in which they had administered the estate. We took a detailed look at the history of the administration and where issues had arisen in order to advise our clients fully.
We defended the claims on our clients’ behalf by presenting evidence and raising technical arguments which undermined the claims being pursued. We negotiated a favourable settlement and protected our clients’ position on costs whilst also ensuring that they were protected from further claims going forward and could finalise the estate administration without the fear of reprisals.
