The claimant attended West Middlesex Hospital and was assessed by the nursing staff to be at risk of falls. She was also given medication which can cause confusion. The claimant was moved to a ward with poor visibility and had a fall resulting in a neck of femur fracture. The claimant had surgery four days later but unfortunately had a further fall onto her wrist sustaining a distal radius fracture a few days later. This was treated conservatively with a period in a cast.
Liability was admitted in the Letter of Response and following negotiations with the Defendant, a negotiated settlement was achieved for £45,000.
