The claimant had attended the emergency department following a fall at home. She had an x-ray of the right foot which was not reported at the time and she was discharged home. The x-ray was reported as showing a possible fracture but the claimant was never recalled for further investigations. Consequently the claimant developed a deformed right foot with pain over the foot and ankle.
Liability was partially admitted in the Letter of Response and following negotiations with the defendant, a negotiated settlement was achieved for £45,000.
