Compensation recovered for injuries caused during knee replacement surgery

This resulted in a prolonged recovery during which E continued to suffer associated symptoms impacting upon daily activities.

At age 85, E underwent knee replacement surgery at Maidstone Hospital. Afterwards, she was advised that during the operation, the surgeon had ‘notched’ her femur causing damage and increasing her risk of fracture.

Advice was taken from an expert consultant orthopaedic surgeon. She agreed that the injury was caused negligently and reported that the injury had healed adequately with no risk of other complication. E’s financial losses were considered and her claim for pain, suffering and loss of amenity was assessed. A letter of claim was sent and an offer of settlement was made. The defendant admitted liability and made a counter offer which was not accepted. Thereafter negotiations took place which concluded with a settlement of £10,000 plus E’s costs.
