Compensation recovered for proceeding with a caesarean section with inadequate anaesthesia

The claimant attended hospital to give birth to her first child. A decision was made to proceed with a caesarean section by spinal anaesthesia. Inadequate checks were performed by the doctors to check the anaesthetic was working and the claimant felt the first contact of the knife to the skin. She was subsequently diagnosed with anxiety and depression.

Liability was denied in the Letter of Response but admitted in the supplemental Letter of Response and following negotiations with the Defendant, a negotiated settlement was achieved for £13,000.
