Resolving multiple claims against an estate from different parties

Our Wills, Trust & Estate Disputes team were recently instructed by the administrator and beneficiary of the deceased’s estate who was facing three separate claims against the estate from multiple parties. Matters were aggravated by the intensity of the litigation and the value of the estate which meant that a resolution needed to be reached quickly and with as little expenditure as possible. In addition, the claims were blocking the administration of the estate which was aggravating the situation.

Our Wills, Trust & Estate Disputes team successfully negotiated favourable settlements for all three claims, which even on an optimistic assessment, saved the estate tens of thousands of pounds. This was thanks to a sophisticated strategic approach by the team in collaboration with the client. The deadlock in the estate was therefore resolved which allowed the administration to be completed quickly by our Probate Team, who were instructed to administer the estate and were able to work seamlessly with the Wills, Trust & Estate Disputes team to finalise matters. This allowed our client to receive their entitlement within a matter of weeks following the settlement of the claims.
