We acted for the Claimant, a well-known security systems company, in proceedings brought in the Technology and Construction Court against the Defendants, a fire and security group of companies.
The claim was for substantial damages (in excess of £500,000), arising from works our client was contracted to carry out for the Defendants at different projects all around Europe. On our advice, our client made an application for summary judgment on the majority of its claim, which was successful.
Our client was awarded substantial damages at an interim stage, together with an order for the costs of the application, and the claim aspects covered by the summary judgement, to be paid by the Defendants.
This strategy enabled us to subsequently negotiate a satisfactory settlement on the other part of our client’s claim not subject to the summary judgment application and a counterclaim which was being pursued by the Defendants.
