Government consults on freehold estate protections – how might developers be affected?

On 18 December 2025, the Government launched a consultation aimed at tackling concerns around new build freehold estates; where homeowners on freehold estates pay ongoing estate management charges and are reported to be left with inadequate infrastructure arrangements.

What’s in the consultation?

The consultation will examine the main reasons for unadopted estate infrastructure (such as roads and drainage) that lead to private estate management. It proposes to seek views on:

  • How to improve adoption of estate infrastructure by local authorities
  • Whether certain types of infrastructure should be mandatorily adopted while considering exceptions for premium or exclusive features
  • The barriers to public adoption and incentives for non-adoption
  • Improving dispute resolution mechanisms, data transparency and management structures
  • Financial sustainability of estate management charges and introducing affordability safeguards.

Why it matters for developers

Many new build estates include private estate charges where local authority adoption of infrastructure does not occur. The consultation signals that the Government is considering policy changes that could affect delivery and handover of estates and cause additional development costs.

  • Adoption expectations: There may be stronger pressure and future requirements to secure adoption of estate roads and drains to avoid private charges for homeowners
  • Estate management frameworks: Greater transparency, reporting and governance obligations may apply for estate management companies if infrastructure is not adopted.

Developers will be keen to ensure that any reforms strike the right balance between consumer protection and practical deliverability. Key points for consideration are likely to be:

  • Unintended impacts on housing delivery
  • Flexibility where adoption may not be possible or practical
  • Transitional arrangements for existing schemes
  • A proportionate approach having regard to factors such as the diversity of schemes and their complexities, costs and risks.

The consultation is part of the Government’s wider drive to strengthen homeowners’ rights. The consultation remains open until 12 March 2026 and industry stakeholders, including developers, will have the opportunity to respond.
