Employers continue to face significant financial exposure in discrimination claims, and one of the most substantial elements of compensation can be the award for injury to feelings. These awards are assessed by reference to the Vento bands, which are reviewed annually. The latest update applies to claims presented to the Employment Tribunal on or after 6 April 2026.
Updated Vento Bands
The new figures reflect the latest adjustment under the Presidential Guidance to take account of changes in the Retail Prices Index. The revised bands are:
- Lower band: £1,300 to £12,600 – For less serious cases of discrimination, which may include isolated or one-off acts. .
- Middle band: £12,600 to £37,700 – For serious cases that do not merit an award in the upper band, including cases involving repeated or sustained discriminatory treatment. .
- Upper band: £37,700 to £62,900 – Reserved for the most serious cases, such as prolonged or particularly serious discriminatory conduct. The most exceptional cases may exceed £62,900.
What this means for employers
Employers should be aware that the updated bands may:
- Increase the potential financial liability in discrimination claims
- Increase expectations from individuals during settlement discussions
- Make it even more important, from a financial risk perspective, to take steps to prevent discrimination and to manage discrimination complaints effectively.
Reducing your organisation’s risk
With the updated bands now in force, employers should take proactive steps to minimise exposure, including:
- Reviewing equality, diversity, and inclusion policies
- Ensuring managers receive regular training on discrimination and complaint handling
- Conducting prompt, well‑documented investigations
- Seeking early legal advice where a claim may arise
